220.017 – TIMELY WARNING POLICY

POLICY

The Clery Act requires that we notify the public of certain crimes which occur within Clery-designated geography. These reports are called timely warnings. Clery geography covers campus and campus-owned properties but not the surrounding neighborhoods.

PROCEDURE

In the event that a situation arises, that, in the judgment of the Campus Oversight Team, constitutes an ongoing or continuing threat to MMW+C’s community, a campus-wide “timely warning” will be issued. The warning will be issued as soon as pertinent information is available. One or all (working together) of the Campus Oversight Team (COT) will determine what information should be conveyed in the warning, and will initiate the notification process. The timely warning will be issued through MMW+C’s e-mail, and may also be issued through text messages and/or cell phone calls. The timely warning will be distributed to all MMW+C’s students, faculty, and staff who are present at the time of the incident.

Anyone with information warranting a timely warning should report the circumstances to a COT team member, by phone, email, or in person.

Sex Offenses – The Clery Act has four defined sex offenses for which crime statistics must be collected on Clery geography. They are: rape, fondling, incest and statutory rape.
Alcohol, drug and weapon violations – The Clery Act requires institutions collect statistics for violations of state law and or ordinances for drug, alcohol and weapons violations.
Liquor Law Violations
Weapons Possession
Drug Abuse Violations
Hate Crimes – The Clery Act requires institutions collect crime statistics for hates crime associated with either the commission of a primary crime or the lesser offenses of larceny-theft, simple assault, intimidation, destruction of or vandalism of a buildings or property.

A Hate Crime is a criminal offense that manifests evidence that the victim was intentionally selected because of the perpetrator’s bias against the victim.

Under the Clery Act, Hate Crimes include any of the following offenses motivated by bias: Murder and Non-negligent Manslaughter, Sexual Assault, Robbery, Aggravated Assault, Burglary, Motor Vehicle Theft, Arson, Larceny-Theft, Simple Assault, Intimidation, Destruction/Damage/Vandalism of Property. Larceny-Theft, Simple Assault, Intimidation, and Destruction/Damage/Vandalism of Property are included in your Clery Act statistics only if they are Hate Crimes
